MY JOLIE PLACE LIMITED - TERMS OF BUSINESS
These Terms govern how we, My Jolie Place Limited ("the Agency"), introduce candidates ("Candidates") to you ("the Client"). By using our services, you agree to these Terms.
Key Definitions

Agency: My Jolie Place Limited, registered in England (Company No. 13355009).

Client: Any person or company looking to hire through the Agency.

Candidate: A nanny, housekeeper, maternity nurse, household manager, or similar domestic worker introduced by us.

Engagement: Any agreement to hire or use a Candidate, whether permanent, temporary, full-time, or part-time.

Fee: Our introduction charges (set out in Schedule 1).

Permanent Placement: An Engagement lasting longer than 8 weeks.

Temporary Placement: An Engagement up to 8 weeks.
-
Overseas Placement: A job based outside the UK.
Our and Your Responsibilities

We will try to introduce suitable Candidates based on the information you give us.

We will check references and paperwork, but you are responsible for verifying references, qualifications, and right to work.

We are not responsible for a Candidate’s honesty, ability, character, or suitability.

You are responsible for contracts, legal compliance (taxes, insurance, visas), and working conditions.

If you interview or hire a Candidate we introduce, you accept these Terms.

If you already know a Candidate we introduce, you must tell us immediately. If you don’t, the fee will still be payable.
Fees and Payment

Fees apply once you engage a Candidate.

Fees must be paid within 7 days of invoice and before the Candidate starts work.

If payment has not been received within 7 days of the offer of employment, the Agency may decide to resume the candidates job search in order to protect the candidates livelihood. If payment is more than 2 weeks overdue, the Agency’s Replacement Guarantee will no longer apply to the placement. Unpaid accounts will incur all collection costs.

If the Candidate is Overseas, fees must be paid before they book travel.

If fees are late, interest of 8% above the Bank of England base rate will apply.

If you don't pay on time, you lose your right to a free replacement or refund.

VAT will be added to all charges.
Note: If a Candidate is re-engaged within 12 months of introduction or a previous Engagement, a fee will apply.
Replacements and Refunds

If a Permanent Placement ends within 4 weeks, and:

You terminate reasonably, or
-
The Candidate resigns (not due to misconduct, job changes, or false information),
then one free replacement will be offered (subject to availability).

You must notify us in writing within 2 working days of termination.

No replacement or refund if:
-
You change the Candidate’s job, hours, or location.
-
Misconduct or false information causes termination.
-
Fees were unpaid before the start date.
-

After 12 weeks or after a replacement is hired, no further replacement is provided.

The Agency is dedicated to sourcing suitable replacement candidates and has a very high success rate. However, we accept no liability if the Family deems the replacement Candidate profiles to be unacceptable.
Administration Fees:

£200 administration fee if terminated within 4 weeks.

£500 fee if you cancel after terms are agreed but before the start date.

You must reimburse any overseas travel costs if you cancel after travel is booked.
Trial Periods

You may trial up to 2 Candidates for 1 day each without fee (pay Candidate directly).

Trials longer than 1 day are considered Temporary Placements and charged accordingly.

Trials reduce the 4-week free replacement period if the Candidate is hired permanently.

No trial periods are offered for Temporary Placements.
Liability
-
We introduce Candidates but do not guarantee performance or length of employment.

We are not responsible for any costs, losses, or damages caused by the Candidate, except for death or personal injury due to our negligence.

Our maximum liability is the amount of the Fee paid.
Confidentiality and Data Protection

Information we provide is confidential and must not be shared.

If you share our Candidate’s details and they are hired, you are liable for the Fee.

We process personal data under the Data Protection Act 2018. See our Privacy Policy on our website.
General Terms
-
Notices must be sent by post, courier, or email and will be deemed received within 1 business day.

These Terms are governed by English law.
-
Any disputes will be handled exclusively by the courts of England and Wales.
-
Changes to these Terms must be made in writing.

Important: To qualify for a replacement during the 4-week trial, the invoice must be paid before the Candidate’s start date.
